Brailsford Mill Terms and Conditions
1. Contract;
The hiring contract will be between you the Hirer and the Owner of the property for which
the booking is made and shall be deemed to be made subject to these Conditions of Hire
and governed by English Law. The Contract of Hire is not effective until the owner
dispatches to the Hirer written confirmation of the booking. The contract is for the hire of
the property for holiday purposes only.
2. Reservations;
To reserve the property the client should complete and sign the booking form, return it
together with payment of the non-refundable deposit, 30% of total cost, within 7 days
unless agreed prior. On receipt of this the owner will forward a formal confirmation.
Reservations made within 8 weeks of the start of the rental period require full payment at
the time of booking including the security deposit.
3. Balance Payment;
The balance of the total holiday cost is payable 8 weeks prior to arrival. If the balance
payment is not received, the owner reserves the right to give notice in writing that the
reservation is cancelled.
4. Security Deposit;
The Security deposit should be paid at the time of balance payment at the rate agreed at
time of booking. Security deposits will be refunded within 21 days of departure providing
everything is left in order and no breakages discovered. All damages and breakages are
the legal responsibility of you, the Hirer, and should be notified to the Owner before the
end of your holiday. The cost of damage or breakages shall be payable from the security
deposit. Normally, minor damage or breakages will not be charged but in circumstances
where extra cleaning is required or there has been breakage or damage beyond what is
reasonably to be expected, the Owner reserve’s the right to charge for any additional costs
incurred as a consequence.
5. Client Cancellations;
Subject to point 3, in the event of a cancellation any monies paid will be non refundable
UNLESS the property can be relet to the same value, any losses will be taken from money
already paid by the client. The client is advised to arrange comprehensive travel insurance
(including cancellation cover), baggage, personal belongings and public liability etc, as
these things are not covered by the owners insurance policy.
6. Owners Cancellations;
The owner may in exceptional circumstances be required to cancel the booking in which
case a full refund of all monies paid will be made to the client. No compensation will be
given if this occurs.
7. Rental Periods;
The rental periods commence from: Friday/Monday 4pm – 10.30am and Friday/Sunday
4pm – 4.30pm. Any different arrangements will be given in writing to the customer.
8. Care of Property;
You are responsible for the property and are expected to take all reasonable care of its
furniture, fittings and effects, in or on the property. You must leave them in the same state
of repair, and in the same clean and tidy condition at the end of the rental period as at the
beginning. You must not use the properties for any dangerous, offensive, noxious, noisy,
immoral activities or carry on with any act that may be a nuisance or annoyance to the
owner or other neighbouring properties. We request noise to be kept to a minimum
between the hours of 10pm and 7am. All night parties are not permitted.
9. Liability;
The owner shall not be liable to the client for any temporary defect or stoppage of public
services to the property, nor in respect of any equipment, machinery or appliances in the
property or garden. Nor for any loss, damage, or injury, which is the result of any adverse
weather conditions, riot, war, strikes or other matters beyond the control of the owner. The
owner is also not liable for any loss, damage or inconvenience caused to or suffered by
the client if the property shall be destroyed or substantially damaged before the start of the
rental period. In such an event the owner shall give notification to the client within 7 days
and refund the client all sums previously paid in respect of the rental period.
10. Occupancy;
Under no circumstances may more than the maximum number of persons stated on the
web site occupy the property. We reserve the right to refuse admittance if this condition is
not observed. Any persons other than members of your party must not use the facilities at
Brailsford Mill, unless prior written consent has been obtained by us. To exceed the
maximum number of persons in the property overloads the facilities available which are
not designed or capable of supporting additional usage, and can lead to extensive and
expensive damage. As such any over occupancy is considered to be a serious
infringement of the Terms and Conditions and can result in an immediate requirement to
vacate the premises, with no refund of monies due, and possible further charges in the
event of damage to the facilities caused by excess usage.
11. General Conditions;
Under no circumstances shall the owner’s liability to the client exceed the amount paid to
the client for the rental period.
The client will not remove any of the contents from the property or make any addition or
alteration to the property.
The owner shall have no liability for personal injury or death. No liability is accepted by the
owner in respect of damage to or loss of personal property of the client.
The client is responsible for insuring their own contents and personal effects kept at the
property.
The owner reserves the right to refuse hand over of the property to the client or repossess
the property if the owner reasonably believes damage has been caused or is likely to be
caused to the property by the client. These circumstances will be treated as a cancellation
by the client, no refund of monies paid will be made and the owner accepts no liability
towards further costs incurred by the client.
12. Well behaved pets are allowed in the property – a maximum of 2 per break at a cost of £22
per dog. Pets shall not be left alone unattended in the property at any time.
Candles of any type are not permitted. Candle related fires invalidate the insurance, and
the client would assume responsibility for any damage.
Smoking is not allowed inside the property. Smoking related fires invalidate the insurance,
and the client would assume responsibility for any damage.
It is recommended that the client takes out their own holiday insurance to cover their own
belongings and accidental damage to third party property. On request, details of holiday
insurance companies can be given.
13. The property is not suitable for all night parties, inside or out. By causing noise and
nuisance to neighbours and or wildlife we reserve the right to terminate your stay.
The property has ponds and uneven ground on site. Some surfaces can become slippery
and care must be taken. Children must be supervised at all times inside and outside the
property.
Please note that the information available on this web site may be incomplete, out of date
or incorrect. It is therefore essential that you verify all such information with us before
taking any action in reliance upon it.
Any vehicle parked on site or any third party making use of the property during the period
during your reservation is left at the property entirely at the risk of the owner.
Legal;
In the event of any dispute between parties it shall be governed by the jurisdiction of the
English courts only and any actions shall be heard in the court for the area in which the
property is located unless otherwise agreed between the parties. However, it is hereby
agreed and declared that all reasonable endeavours will be used to resolve the dispute
arising between you and the owner without immediate recourse to litigation.
